Important legal agreements

Tonio Service provides web hosting to clients across the world, and we have a responsibility to protect every client and provide the best services available. All Tonio Service customers are subject to the following conditions of use:

Compensation policy

You agree to use all Tonio Service services and facilities at your own risk. Tonio Service expressly disclaims all warranties of merchantability and fitness for a particular purpose. In no event will Tonio Service be liable for any loss, loss of data, or other commercial damages, including, but not limited to, special, incidental, consequential or other damages.

Customer agrees to defend, indemnify, save and hold harmless Tonio Service from any demands, liabilities, losses, costs and claims, including reasonable attorneys' fees, alleged against Tonio Service, its agents, customers, officers and employees, which may arise or result from any service provided or performed or agreed to be performed or any product sold by Customer, its agents, employees or assignors. Customer agrees to defend, indemnify and hold Tonio Service harmless from any liability arising from any injury to any person or property caused by any product sold or otherwise distributed in connection with Tonio Service's server.

Tonio Service reserves the right to intervene with any of the sites hosted on its servers in the interest of its customers. Any material provided by the customer infringing or alleging to infringe the property rights of a third party, copyright infringement, any defective product sold to the customer by the Tonio Service server. Tonio Service will be the sole judge of what violates this policy.

Billing

Currently, we bill monthly, quarterly, semi-annually and annually, depending on the plan. If you're not satisfied within the first 30 days, we'll be happy to issue you a full refund (for some special offers, the money-back guarantee will vary; and domain name registration fees are non-refundable).

We accept Visa, Mastercard, American Express and Discover Card. For web hosting plans, we set up your account without any payment. We encourage customers to pay by credit card as this is currently the easiest way to handle payment. There are no contract periods, but for each successive period your contract is automatically renewed unless you notify us otherwise.

Late payments

All accounts are billed based on activation dates. If you do not pay for service renewal within 5 days of deactivation, your account will be suspended. If you do not pay for service renewal within 30 days of deactivation, your account will be terminated. You will receive a reminder by email 5 days before deactivation.

All services offered by Tonio Service may only be used for legal purposes. The transmission, storage or presentation of any information, data or material in violation of any United States federal, state or city law is prohibited. This includes, but is not limited to: copyrighted material, material that we deem threatening or obscene, or material protected by trade secret and other laws. Subscriber agrees to indemnify and hold Tonio Service and its employees harmless from any claims resulting from use of the Service that damages Subscriber or any other party. Our acceptable use policy is actively and strictly enforced. Offending content or users are suspended from our network, usually as soon as they are discovered, although we will always inform you of the reason for any action taken. Pornography is prohibited on all Tonio Service servers. This includes sites that include explicit or hardcore images or advertisements.

The Subscriber acknowledges that the service provided is likely to be interrupted for many reasons other than the negligence of the Company and that the damages resulting from any interruption of service are difficult to assess. Therefore, Subscriber agrees that Company shall not be liable for any damages arising from such causes outside of Company's direct and exclusive control.

Subscriber further acknowledges that the Company's liability for its own negligence shall in no event exceed an amount equivalent to the fees payable by Subscriber for the Services during the period in which the damage occurred. In no event will the company be liable for any special or consequential damages, losses or harm.

Illegality in any form, including but not limited to unauthorized distribution or copying of copyrighted software or other data, harassment, fraud, trafficking in obscene material. Unwanted content Certain types of content are not allowed on our network. We do not host adult content of any description. Content related to hacking, cracking, warez and IRC is not allowed. Software, audio and video recordings may only be hosted if you are the author and copyright owner of the resources or have the right to distribute the materials. Accounts suspended due to content or acceptable use policy violations are not refunded under any circumstances.

Limitation of liability

Tonio Service will not be liable for any alleged damages, including indirect and consequential damages, which may result from the unavailability of Tonio Service servers for any reason. Furthermore, Tonio Service will not be liable for any alleged damages, including indirect or consequential damages, resulting from the corruption or deletion of any website from any of Tonio Service's servers. All damages will be limited to immediate termination of service.

Warning

Tonio Service cannot be held responsible for system unavailability, crashes or loss of data. We cannot be held responsible for any predicted profit estimates in which a client would have earned had they been in office. Certain services provided by Tonio Service are resold. Therefore, certain equipment, routing, software and programming used by Tonio Service are not directly owned or written by Tonio Service. Furthermore, Tonio Service is not responsible for the use of our customer accounts. If any of the terms or conditions are violated, the account in question will be automatically deactivated. We reserve the right to terminate any account without notice for any reason without restitution at the discretion of Tonio Service. IN ADDITION, Tonio Service reserves the right to change all of the above policies, guidelines and disclaimers without notification.
